Week in Signal: The EEOC is withdrawing its background check guidance, and the liability for how you screen is not going away

Issue 2026-10-10 Daily 9 insights · 3 actions · 4 min read

The week's best signals in one place, each with a note on why it matters, three actions worth the time, and something lighter for the weekend.

The EEOC is dropping its background check guidance, not the liability↗

The EEOC sent a final rule to the White House rescinding its 2012 guidance on using arrest and conviction records in hiring, HR Dive reported October 8. Littler lawyers warned that private claims under Title VII still stand.

2012
the year of the guidance now being withdrawn
Why this mattersRemoving the federal guidance does not remove the lawsuit. If your screen rejects on any criminal record, write down which job duty each check protects and who signed off. A blanket rule still falls hardest on one group, and a private plaintiff can still sue.

A proposed rule puts a six-figure fee behind each international graduate↗

The Department of Homeland Security proposed on October 7 that colleges pay 70,000 dollars for each international student's first work permit, plus 30,000 for each extension. About 294,000 students used the program in 2024-25.

$100,000
per student, if a school pays both fee stages
Why this mattersSchools pay the fee, and the department said they may pass it to students or employers. If you hire recent graduates on student work permits, ask your immigration counsel this month which of next year's offers depend on it, and budget a second option.

The EEOC filed fewer suits and said more, and disability cases led↗

Law firm Seyfarth Shaw counted 97 EEOC merit lawsuits in the year to September 2026, with 29 filed in September against 71 in September 2023. Disability claims were 38 of the 97, and two district offices filed nearly a quarter.

38 of 97
EEOC suits last year that were disability claims
Why this mattersFewer filings is not less exposure, and disability is where the agency still spends its time. Pull your accommodation requests from the past year and check that each one has a written answer and a dated reason. That file is the whole defense.

Best of the week: science & technology

Researchers are hiding details from AI tools after being beaten to results↗

Nature reported on October 8 that at least two research teams in five weeks said AI systems announced results they were still working on. Several scientists now strip names and details out before pasting their work into commercial AI tools, and both OpenAI and Anthropic denied training on those uploads.

5 weeks
in which two teams said AI got there first
Why this mattersThe habit to watch is not the AI, it is what your team pastes into it. Write one page naming what may go into an AI tool and what may not, such as candidate files, pay data and unsigned contracts, and send it to everyone this week.

Watching the middle of the process turned up materials nobody had seen↗

Sebastian Pike at the University of Warwick and Dominik Kubicki at the University of Birmingham heated chemical starting materials and, instead of testing only the final product, tracked what formed along the way. They found several unknown stages, one a new form of a solar fuel material and one that stores large amounts of lithium, published in Nature Communications.

2 finds
useful materials seen only in the in-between steps
Why this mattersThey measured the steps between the start and the finish, which is where nobody usually looks. Your hiring funnel is the same. Count the days between application and first interview this quarter, because the loss happens in the gap, not at the decision.
Science

A country that hired outside help once has now built the spacecraft itself↗

The Technology Innovation Institute in Abu Dhabi finished the United Arab Emirates' first home-built space probe on October 1, Nature reported on October 8. The 10-kilogram craft launches in 2028 to reach an asteroid in 2035, and university enrollment in science and engineering is up 30% since the country announced its first Mars mission in 2014.

30%
rise in science enrollment since the goal was set
Why this mattersTheir first mission was built with outside partners and used to train their own engineers, so the second one did not need them. Do that with your next consultant. Name the person on staff who shadows the work, and put the handover date in the contract.

Practice only stuck after a night of sleep replayed it back↗

Emmett Thompson and Lars Rollik at University College London watched mice replay a learned movement sequence during sleep, often faster than real time. Blocking the replay sent next-day performance back to the start, published October 8 in Nature Neuroscience.

1 night
of sleep decided whether the practice held
Why this mattersNothing was lost during practice, it was lost overnight. Stop scheduling training the day before a push. Run the session, let people sleep, and check the real work two days later instead of asking what they thought at the end.

Lighter side

Top 2

Something lighter for the weekend, with one small idea attached.

Lighter

A glowing yellow coral needed hundreds of genes to be filed correctly↗

Odalisca Breedy at the University of Costa Rica named a golden coral over a meter tall, found 360 to 529 meters down off Central America. Three common genes pointed to the wrong family, and hundreds of genes gave it a new one, published October 8 in ZooKeys.

3 genes
gave the wrong answer; hundreds got it right
Why this mattersThree signals put it in the wrong family and more signals fixed it. Your hiring scorecard works the same way. If you rank candidates on one test score or one school name, add two signals drawn from the actual work before you decide.
Lighter

Four people came home after 237 days and 100 million miles at work↗

NASA's Jessica Meir and Jack Hathaway, with Sophie Adenot of the European Space Agency and Andrey Fedyaev of Roscosmos, splashed down off Los Angeles on October 8 after 237 days in orbit and more than 3,792 trips around the Earth.

237 days
one crew rotation, planned before launch
Why this mattersA 237-day stint ran on a rotation set before launch, not on who was still standing. Long absences at your company deserve the same. Before the next parental leave or sabbatical, write down who covers what and have them overlap for a week.

Three things to do this week

3 actions

Three moves with the best payoff for the least effort, each with what it is roughly worth. Even one of them saves hours of work, cash, or a risk you would rather not carry.

1
Risk
Tie every background check rejection to a job duty
List every role where a criminal record can disqualify a candidate. Next to each, name the job duty it protects and who approved it. Delete any blanket rule you cannot connect. Two hours.
PayoffThe EEOC is withdrawing its 2012 guidance, but Title VII claims by private plaintiffs remain, and a blanket screen is the easiest kind to challenge. Defending one hiring discrimination charge commonly runs tens of thousands in legal fees before any settlement.
$25k+
legal defense cost on one hiring claim
Effort 2 hours
2
Data
Write one page on what may and may not go into an AI tool
Name the AI tools your team actually uses. List what may be pasted in and what may not, such as candidate files, pay data, health notes and unsigned contracts. Send it to everyone. 90 minutes.
PayoffResearchers are now stripping details out of their own work before using commercial AI tools. Pay and candidate data leaving through a chat window is a privacy complaint and a contract breach at once, and the cleanup costs far more than the page did.
$20k+
cleanup and legal cost of one data leak
Effort 90 minutes
3
Retention
Give every accommodation request a written answer and a date
Name one inbox for medical and religious accommodation requests. Answer each in writing within ten working days, record the reason behind any no, and check the past year for gaps. Two hours.
PayoffDisability claims were 38 of the 97 lawsuits the EEOC filed last year, and these cases turn on what was written at the time. Defending a single accommodation charge commonly runs tens of thousands in legal fees, and the employee usually stays if the answer comes.
$40k+
legal defense cost on one accommodation claim
Effort 2 hours
